Health Data & AI Risk Disclaimer
Effective date: September 22, 2025 Applies to: the BiomeAI agent and related interfaces that let you type, paste, upload, or otherwise submit information (the “Agent”).
TL;DR (plain language)
Don’t enter anything you wouldn’t be comfortable seeing exposed.
AI can be wrong; it’s not medical advice.
We try to protect your data, but no system is 100% secure.
You use the Agent at your own risk and with your explicit consent to process health data.
1) Scope & who we are
This notice covers how the Agent handles what you enter, including information about your health, microbiome, lifestyle, or other special-category data. It sits alongside (and does not replace) our general disclaimer, privacy policy, and terms of use.
2) Not medical care; emergency rules
The Agent provides informational and educational content only. It does not diagnose, treat, or prevent disease, and it is not a substitute for professional care. If you have an emergency, call your local emergency number immediately. Use of the Agent does not create a doctor-patient relationship.
3) What happens to the data you enter
Transfers to service providers. To generate responses, the Agent may send your inputs (and derived outputs/metadata) to third-party AI/model providers, cloud infrastructure, and security/analytics tools. Some of these services are located outside your country.
Model/provider policies. Where technically available, we configure providers not to use your inputs for model training; however, providers may still process your data for safety, abuse prevention, logging, and legal compliance.
No absolute security. We employ technical and organizational safeguards, but no electronic system is perfectly secure. We cannot guarantee confidentiality, integrity, or availability of data transmitted to or from the Agent.
Retention. Operational logs and transcripts are retained for troubleshooting, safety, and to improve the Agent. We keep the memories that you create by chatting with the agent to improve your personal experience with the agent. It can give better answers if it knows what happened in the past.
Research & product improvement (optional). If you opt in, we may use de-identified/aggregated data to improve models, evaluate features, or support research. You can withdraw this choice at any time (see Section 8).
4) Your responsibilities (how to reduce risk)
Avoid direct identifiers. Do not include your full name, precise address, phone, government IDs, or names of third parties unless necessary.
Anonymize files. Redact PDFs/images before uploading.
Sanity-check outputs. AI can be inaccurate or outdated. Verify important points with qualified professionals.
Use secure networks. Prefer trusted devices and connections.
5) Legal basis & consent for special-category data
Because you may provide health information, we rely on your explicit consent to process such data for the purposes described here (GDPR/UK GDPR Art. 9(2)(a); Swiss FADP: sensitive data). You can withdraw consent at any time (Section 8). If you do not consent, do not use the Agent for health data.
6) International transfers
Your inputs may be processed in jurisdictions that do not offer the same level of data protection as your home country. By using the Agent, you acknowledge and accept these cross-border transfers. We use appropriate safeguards where required.
7) HIPAA status (US users)
We are not a HIPAA “covered entity” or “business associate.” The Agent is not intended for transmitting PHI in HIPAA-regulated workflows.
8) Your privacy rights
Subject to law and technical feasibility, you may have rights to access, correct, delete, restrict, object to processing, data portability, and to withdraw consent (this won’t affect processing completed before withdrawal). To exercise rights, contact: privacy@microbiomedao.com. We may need to verify your identity and may be unable to delete data we must keep for legal or safety reasons.
9) Children
The Agent is for adults (18+). Do not submit data about minors without verifiable parental/guardian authority and compliance with applicable law.
10) Limitation of liability; assumption of risk
You understand and agree that:

We provide the Agent “as is” and “as available.”
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Agent.
11) Changes
We may update this notice to reflect changes in our practices or the law. Material changes will be signposted in the GitBook and, where required, notified to you.
